The rules for using this site
These Terms of Use (“Terms”) govern your access to and use of the website getyourfenceon.com (the “Site”), operated by Get Your Fence On LLC (“Get Your Fence On,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
By using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Disclaimer, which are incorporated here by reference.
You must be at least 18 years old and able to enter into a binding agreement to use the Site or request services. The Site is not directed to anyone under 18.
The Site provides information about our fence installation and related services in Missouri and Kansas, and lets you request estimates, book appointments, and communicate with us. The Site itself is informational. Submitting a form or request does not create a contract for work and does not obligate us to provide services.
The actual terms for any fence installation or related work are set out in a separate written agreement signed by you and Get Your Fence On (the “Agreement”). The Agreement controls the scope, pricing, payment, warranty, cancellation rights, and all other terms of the work. Nothing on the Site or in these Terms modifies, replaces, or limits the Agreement. If there is any conflict between these Terms and the Agreement regarding the work, the Agreement controls.
Prices and estimates shown or generated through the Site are for reference only, are not offers, and are subject to change. Final pricing applies only as stated in the Agreement.
Online payments and deposits are processed by our third-party processor, Stripe , and are subject to Stripe’s terms. We do not store full payment-card numbers on our systems.
Any deposit, payment schedule, and refund or cancellation terms are governed by the Agreement and applicable law.
By providing your contact information, you consent to receive communications from us electronically, including by email, phone, and (if you opt in) text message. You opt in to texts by giving us your mobile number and agreeing to receive them - for example, by checking the SMS consent box on a form, texting us first, or asking us to text you. Consent to receive marketing or promotional texts is not a condition of purchasing any product or service. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of texts or HELP for help. Our handling of your information, including SMS consent data, is described in our Privacy Policy, which states that we do not share mobile opt-in information with third parties or affiliates for marketing purposes.
You agree not to:
Use the Site for any unlawful, harmful, or fraudulent purpose;
Submit false, misleading, or another person’s information without authorization;
Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems;
Use any automated means to scrape, copy, or harvest content or data from the Site;
Introduce malware or otherwise compromise the security or integrity of the Site.
The Site and its content - including text, graphics, logos, images, and design - are owned by or licensed to Get Your Fence On and are protected by applicable law. You may view and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission.
Any information, photos, reviews, or other content you submit to us (other than your personal information, which is handled under our Privacy Policy) may be used by us in connection with our business. You represent that you have the right to submit that content and that it does not violate any law or third-party right. Do not submit anything confidential that you do not want us to use.
The Site may use or link to third-party services (such as payment, scheduling, messaging, or advertising platforms). We are not responsible for third-party services or websites, and your use of them is governed by their own terms and policies.
The Site is provided “as is” and “as available” without warranties of any kind. Please review our Disclaimer, which forms part of these Terms.
To the fullest extent permitted by law, Get Your Fence On and its owner, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or relating to your use of the Site. Our total liability for any claim arising from your use of the Site is limited to the amount you paid (if any) to access the Site. This limitation applies to the Site only; it does not limit, expand, or modify any rights or obligations under the signed Agreement, which governs the work. This Section is consistent with the Disclaimer, which forms part of these Terms.
You agree to indemnify and hold harmless Get Your Fence On from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms or applicable law.
We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including weather, natural events, supply or material shortages, labor issues, utility-locate delays, or acts of third parties. This Section applies to the Site; the Agreement governs any effect of such events on actual fence work.
Before bringing any formal claim relating to the Site, you agree to first contact us at Admin@GetYourFenceOn.com and give us a reasonable opportunity to resolve the matter informally. Disputes about actual fence installation work follow the dispute terms in the Agreement.
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules, and any dispute relating to the Site will be brought in the state or federal courts located in or serving Missouri. Nothing in this Section waives any mandatory consumer-protection right you have under the law of your home state, including the Kansas Consumer Protection Act for Kansas residents. Disputes about actual fence installation work are governed by the separate signed Agreement, including its state-specific provisions for Missouri or Kansas projects, which control over this Section for that work.
We may provide notices to you by email or by posting on the Site. You may send notices to us at Admin@GetYourFenceOn.com or by mail at the address below.
We may assign or transfer these Terms in connection with a merger, sale, or transfer of our business or assets. You may not assign your rights or obligations under these Terms without our prior written consent.
Our failure to enforce any provision of these Terms is not a waiver of that provision or of our right to enforce it later.
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date and version above. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and Get Your Fence On regarding your use of the Site. They do not replace the Agreement governing any work.
